THE NORTHUMBRIAN WATER LIMITED (LAND AT CRASTER AND DUNSTAN)
COMPULSORY PURCHASE ORDER 2008

Northumbrian Water Limited have submitted to the Secretary of State for Environment, Food and Rural Affairs for confirmation a Compulsory Purchase Order made by them under section 155 of the Water Industry Act 1991 and the Acquisition of Land Act 1981. This would authorise them to acquire compulsorily the land and compulsorily acquire the rights referred to in the Schedule hereto for the purpose of carrying out their functions as a statutory water undertaker, and in particular, the construction of a new replacement sewage treatment works at Dunstan to serve the catchments of Craster North, Craster South and Dunstan and the installation of two new underground pumping stations at Craster North and Craster South as described in the Schedule hereto.

NOTICE IS HEREBY GIVEN that a public local inquiry into this matter will be held by Mr Robert Lyon MA, CENG, MICE, MRTPI, FIHT at Craster Memorial Hall, Whin Hill, Craster, Alnwick, Northumberland, NE66 3TP on 24 March 2009 at 10.00am.

A copy of the Order and of the accompanying map may be seen at all reasonable hours at the Cottage Inn, Dunstan, Northumberland, NE66 3SZ and the Jolly Fisherman, Haven Hill, Craster, Northumberland, NE66 3TR

SCHEDULE

1. All interests in 42.29 square metres of the tarmacced / gravelled / partially planted land situated on the eastern side of Dunstanburgh Road (the U3070), Craster and opposite 31 Dunstanburgh Road except those already owned by the acquiring authority.

2. 29.94 square metres of tarmacced / gravelled / planted land on the eastern side of Dunstanburgh Road (the U3070), Craster, being opposite 31 Dunstanburgh Road and being all the land between Plot I and the coastal slope excluding the comminutor station and kiosk.

3. 99.46 square metres of grassed land situated on the eastern side of Dunstanburgh Road (the U3070), Craster being generally opposite 33 Dunstanburgh Road and used as a garden area for 33 Dunstanburgh Road.

4. 91.40 square metres of gravelled land situated on the eastern side of Dunstanburgh Road, Craster being generally opposite 35 Dunstanburgh Road which is used as a garden/parking area for 35 Dunstanburgh Road.

5. 71.93 square metres of grassed / planted land situated on the eastern side of Dunstanburgh Road (the U3070), Craster being generally opposite 37 Dunstanburgh Road which is used as a garden area for 37 Dunstanburgh Road.

6. 107.51 square metres of grassed / planted land situated on the eastern side of Dunstanburgh Road (the U3070), Craster being generally opposite 39 Dunstanburgh Road which is used as a garden area for 39 Dunstanburgh Road.

7. 73.73 square metres of grassed garden land being the northern end of the garden belonging to the house known as "Emblestones", South Acres, Craster.

8. 24.36 square metres of grassed garden land which is part of the garden belonging to the house known as "Emblestones", South Acres, Craster and which is immediately to the south of Plot 7.

9. 4.82 square metres of grassed land located between the existing boundary wall of the house known as "Emblestones", South Acres, Craster and the south eastern corner of Heugh Road (the U3090), such land being to the west of Plot 7 and to the south of Plot 10.

10. 212.71 square metres of grassed land being at the southern end of the open recreational area to the south of the playground, and which is immediately to the north of the boundary fence of the house known as "Emblestones" and which is to the east of the southern end of Heugh Road (the U3090).

11. 1527.49 square metres of the grassed recreation area to the south of the playground, and to the east of Heugh Road (the U3090), Craster.

12. 472.96 square metres of the agricultural field to the west of the existing sewage treatment works at Dunstan, being that portion immediately adjacent to the existing sewage treatment works.

13. 8626.49 square metres of the agricultural field to the west of the existing sewage treatment works, and adjacent to Plot 12.

14. 127.97 square metres of land between Craster Beck and the southern boundary of the existing sewage treatment works at Dunstan; the eastern point of such land being at the eastern corner of the sewage treatment works and the western point being at the western corner of the sewage treatment works.

15. All interests in 69.42 square metres of Craster Beck, running generally parallel to the southern boundary of the sewage treatment works and which is immediately to the south of and abutting Plot 14 except those already owned by the acquiring authority.

DESCRIPTION OF RIGHTS TO BE ACQUIRED

1. Any rights acquired or in the process of acquisition under the Limitation Act 1980 in relation to Plots 3 -6.

2. The legal charge dated 2 August 2007 in favour of the Bank of Scotland PLC so far as it affects Plot 6.

3. Certain restrictive covenants over Plots 7 and 8 referred to in a Transfer dated 13 August 1999 in relation to Plots 7 and 8.
